Terms of use.

Effective October 15, 2026

These Terms of Use apply when you access or use the Remote Employee® website at remoteemployee.com, our talent marketplace, and the RE Portal (together, the “Services”).

By accessing or using the Services, you agree to these Terms of Use. If you do not agree, please do not use the Services.

Hiring, employing, and managing staff through Remote Employee® may be subject to a separate client agreement, service agreement, order form, or other written agreement with us. If there is a conflict between these Terms of Use and a separate agreement governing services we provide to you, the separate agreement will control for those services.

Who we are

The Services are operated by Remote Employee LLC, doing business as Remote Employee® (“Remote Employee,” “we,” “us,” or “our”).

Our U.S. office is located at:

929 Childs St
Wheaton, IL 60187
USA

Our Philippine operations are run by our affiliate, Remote Employee BPO, in San Fernando, Pampanga, Philippines.

You can contact us at info@remoteemployee.com or (844) 680-0626.

Using the Services

You may use our website to learn about Remote Employee®, explore available roles and talent, read our resources, submit a job description, request a consultation, request access to the RE Portal, and contact our team.

If you are given access to the RE Portal, you may also use it to review candidate information and, where available, support activities related to interviewing, selecting, onboarding, and managing your Remote Employee® team.

You agree to use the Services only for lawful business purposes and in accordance with these Terms of Use.

You must provide accurate information when submitting forms, requesting Portal access, creating an account, or otherwise communicating with us.

The availability of individual features may change over time, and some features may only be available to approved users or Remote Employee® clients.

Accounts and access

Some parts of the Services require an account, invitation, or approval from Remote Employee®.

You are responsible for:

  • providing accurate and current account information;
  • keeping your login credentials confidential;
  • restricting unauthorized access to your account; and
  • notifying us promptly if you believe your account or login credentials have been compromised.

You are responsible for activity conducted through your account to the extent permitted by applicable law.

You may not share your login credentials with anyone who is not authorized to access the Services on behalf of your organization.

We may restrict, suspend, or revoke access if we reasonably believe an account is being used without authorization, in violation of these terms, or in a way that could compromise the security of the Services or information available through them.

The talent marketplace and RE Portal

Our talent marketplace and RE Portal are designed to help businesses evaluate candidates and manage their relationship with Remote Employee®.

Candidate profiles may include information such as professional experience, skills, education, availability, role preferences, and other information relevant to evaluating a candidate.

Profiles specifically identified as “Sample” are illustrations of the type of talent that may be available through Remote Employee®. They are not representations of actual candidates currently available for interview or employment.

Unless expressly stated otherwise, displaying a candidate does not guarantee that the candidate is still available, will meet your requirements, will accept an offer, or will ultimately be employed for your account.

Any salary, monthly cost, savings, or other pricing figures displayed through the Services are estimates unless expressly identified otherwise. Actual costs depend on the role, experience level, work arrangement, requirements, benefits, equipment, and other applicable factors.

Your final pricing and commercial terms will be set out in the applicable proposal, order form, client agreement, or other written agreement with Remote Employee®.

Submitting a job description, viewing a candidate, or requesting an interview does not by itself create an employment or service relationship.

If you connect an AI assistant to the RE Portal through our MCP server, you’re responsible for authorizing that connection and for how you use the information the assistant can access. Your use of the assistant itself is governed by its provider’s terms.

Candidates introduced through Remote Employee®

Candidates presented or introduced to you through the Services, the RE Portal, our recruiting team, or another Remote Employee® channel are introduced for the purpose of engagement through Remote Employee®.

You may not knowingly bypass Remote Employee® to directly employ, contract with, engage, or arrange for a third party to engage a candidate introduced to you through Remote Employee®, unless we have agreed to that arrangement in writing.

Any restrictions, conversion fees, placement fees, or other terms that apply to directly engaging a candidate or employee introduced through Remote Employee® will be governed by your applicable client agreement or other written agreement with us.

Nothing in these Terms of Use prevents a candidate from independently seeking employment or restricts any rights that cannot legally be restricted.

Candidate and employee information

Information about candidates and employees made available through the RE Portal is confidential and may contain personal information.

You may access and use this information only for legitimate purposes connected with evaluating, interviewing, selecting, onboarding, or managing staff through Remote Employee®.

You must not:

  • publish or publicly share candidate or employee information;
  • sell, license, distribute, or commercially exploit that information;
  • use candidate information for unrelated recruiting or marketing;
  • download, scrape, collect, or build a separate database of candidate or employee profiles except as reasonably necessary for your authorized use of the Services;
  • provide Portal access or candidate information to unauthorized third parties; or
  • use candidate or employee information in a discriminatory, unlawful, or otherwise prohibited manner.

Your handling of personal information must comply with applicable privacy and data protection laws and any separate agreement you have with Remote Employee®.

Our collection and use of personal information is described in our Privacy Policy.

Intellectual property

The Services and their content—including text, graphics, photographs, videos, illustrations, designs, logos, icons, databases, software, Portal interfaces, and other materials—are owned by or licensed to Remote Employee® and are protected by applicable intellectual property laws.

We give you a limited, non-exclusive, non-transferable, revocable right to access and use the Services for their intended purpose and in accordance with these terms.

You may view, download, or share our publicly available content for your own legitimate informational and business purposes.

Unless we give you written permission, you may not reproduce, modify, republish, distribute, sell, license, create derivative works from, or commercially exploit a substantial part of the Services or their content.

Remote Employee®, our logos, and other Remote Employee® names and marks are trademarks or other protected brand assets of Remote Employee®. Nothing in these terms gives you a right to use our trademarks, branding, or logos without our permission.

Prohibited use

When using the Services, you must not:

  • violate any applicable law, regulation, or another person’s rights;
  • access or attempt to access accounts, systems, information, or areas of the Services you are not authorized to use;
  • scrape, crawl, harvest, extract, or systematically collect candidate, employee, or other non-public information;
  • use automated systems, bots, or similar tools to access the Services in a manner that places an unreasonable load on our systems or bypasses access restrictions;
  • copy candidate or employee information for purposes unrelated to working with Remote Employee®;
  • introduce malware, viruses, malicious code, or other harmful technology;
  • interfere with, disrupt, damage, or attempt to compromise the security or operation of the Services;
  • attempt to reverse engineer or circumvent security, authentication, or access controls, except where applicable law expressly permits it;
  • impersonate another person or organization;
  • submit information that is false, fraudulent, misleading, or unlawfully obtained;
  • use the Services to discriminate unlawfully against candidates or employees; or
  • use the Services for any fraudulent, abusive, unlawful, or unauthorized purpose.

We may investigate suspected violations and take appropriate action, including restricting or terminating access to the Services.

The Services may contain links to, integrations with, or embedded content from third-party websites, platforms, and services, including Google Maps, YouTube, Spotify, and other providers.

These third-party services are operated independently from Remote Employee®.

We do not control and are not responsible for their availability, content, security, privacy practices, or terms.

Your use of a third-party website or service is governed by that provider’s own terms and privacy policies.

A link or integration does not necessarily mean that Remote Employee® endorses the third party or its products or services.

Disclaimers

The Services and information made available through them are provided on an “as is” and “as available” basis to the fullest extent permitted by applicable law.

We work to provide accurate, useful information and reliable access to our Services. However, we do not guarantee that:

  • all information will always be complete, current, or error-free;
  • the Services will always be available, secure, or uninterrupted;
  • every feature will remain available;
  • every candidate displayed will remain available;
  • a particular candidate will be suitable for your business; or
  • use of the Services will produce a particular business, hiring, financial, or operational result.

To the fullest extent permitted by law, Remote Employee® disclaims all warranties, express or implied, relating to the Services, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Articles, guides, calculators, salary information, cost estimates, savings examples, and other resources on our website are provided for general informational purposes.

They are not legal, tax, accounting, financial, immigration, employment, or other professional advice. You should obtain appropriate professional advice for decisions specific to your business.

Nothing on the public website constitutes an offer or guarantee of employment, candidate availability, pricing, savings, or business results unless expressly stated in a written agreement with Remote Employee®.

Limitation of liability

To the fullest extent permitted by applicable law, Remote Employee®, its affiliates, officers, directors, employees, agents, and representatives will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or relating to your access to or use of, or inability to access or use, the Services.

This includes, without limitation, loss of profits, revenue, business opportunities, goodwill, or data, even if we have been advised of the possibility of those damages.

To the fullest extent permitted by applicable law, Remote Employee®’s total aggregate liability arising out of or relating solely to your use of the website, talent marketplace, or RE Portal under these Terms of Use will not exceed US$100.

The limitations in this section apply regardless of the form of action or theory of liability, whether based in contract, tort, negligence, strict liability, statute, or otherwise.

Nothing in these Terms of Use excludes or limits liability that cannot lawfully be excluded or limited.

Liability arising from paid staffing, employment, recruiting, or other services provided under a separate agreement with Remote Employee® is governed by the liability provisions in that agreement rather than the US$100 limitation above.

Indemnification

To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Remote Employee®, its affiliates, officers, directors, employees, agents, and representatives from and against claims, liabilities, damages, judgments, losses, and reasonable costs and expenses, including reasonable attorneys’ fees, arising out of or relating to:

  • your unlawful or unauthorized use of the Services;
  • your material violation of these Terms of Use;
  • information or content you submit through the Services;
  • your misuse or unauthorized disclosure of candidate or employee information; or
  • your violation of another person’s rights or applicable law.

This provision does not change any indemnification rights or obligations contained in a separate agreement between you and Remote Employee®.

Suspension and termination

We may suspend, restrict, or terminate your access to all or part of the Services if we reasonably believe that:

  • you have materially violated these terms;
  • your account is being used without authorization;
  • your use creates a security, legal, privacy, or operational risk;
  • suspension is necessary to protect candidate, employee, client, or Remote Employee® information; or
  • we are required to do so by law.

Where reasonably appropriate, we may give you an opportunity to address the issue before access is terminated.

You may stop using the Services at any time.

Termination or suspension of Portal access does not automatically terminate any separate agreement you have with Remote Employee®. The terms of that agreement govern the suspension or termination of paid services.

Provisions that by their nature should continue after your access ends—including provisions concerning confidentiality, candidate and employee information, intellectual property, disclaimers, indemnification, limitation of liability, and governing law—will survive termination.

Changes to these terms

We may update these Terms of Use from time to time to reflect changes to the Services, our business, legal requirements, or our practices.

When we make changes, we will post the revised terms on this page and update the “Last updated” date.

Where required by law or appropriate because of a material change, we may provide additional notice.

Your continued use of the Services after updated terms become effective constitutes your acceptance of those terms to the extent permitted by applicable law.

Governing law

These Terms of Use and any dispute arising out of or relating to them or the Services will be governed by the laws of the State of Illinois, without regard to its conflict-of-law principles.

Subject to any applicable law that provides otherwise, you and Remote Employee® agree that any legal action arising out of or relating to these Terms of Use will be brought exclusively in the state or federal courts located in DuPage County, Illinois, and each party consents to the jurisdiction of those courts.

If you have a separate agreement with Remote Employee® that contains governing-law, jurisdiction, arbitration, or other dispute-resolution provisions, those provisions will govern disputes covered by that agreement.
